Key Principle: Service engagements are non-refundable except as explicitly stated in this policy or in your specific engagement agreement. Cancellation fees may apply depending on the timing of cancellation.
2. Service Categories & Refund Eligibility
2.1 Speaking Engagements (Keynotes, Panel Discussions)
Refund Eligibility:
- No refund once the speaking engagement date is confirmed and Brett Johnson Services, LLC has committed resources
- Deposits are non-refundable upon confirmation
- Rescheduling is available under certain conditions
Cancellation by You:
- Cancellation more than 90 days before event: 50% refund of deposit
- Cancellation 60-89 days before event: 25% refund of deposit
- Cancellation less than 60 days before event: No refund; full payment due
- Cancellation within 14 days of event: Full payment due + potential damages
Cancellation by Us:
- If we must cancel (illness, emergency), we offer: full refund or rescheduling to mutually agreed date
- If you reschedule, balance due = original terms minus any previously paid amount
2.2 Executive Workshops & Training Sessions
Refund Eligibility:
- Half-day or full-day sessions: Non-refundable after confirmation
- Customization and preparation have commenced upon confirmation
Cancellation by You:
- More than 60 days: 50% refund of contract value
- 30-59 days: 25% refund
- Less than 30 days: No refund; full payment due
Cancellation by Us:
- Full refund or rescheduling at no additional cost
2.3 Retainer Consulting Services
Refund Eligibility:
- Monthly retainers: Non-refundable except for month-to-month arrangements
- Prepaid unused months may be credited to future services
Cancellation by You:
- Month-to-month: 30 days written notice; no refund for current month
- Fixed-term (6, 12 months): Early termination may incur break fees per contract
- Month of cancellation: No refund; services through end of month
Cancellation by Us:
- 30 days written notice required
- Prorated refund for unused portion of current month
- Continuation of services through notice period
2.4 Media Kit & Educational Materials
Refund Eligibility:
- Media kit downloads: Non-refundable; digital goods policy applies
- One-time purchases are final once delivered
Defective Materials:
- If materials are corrupted or incomplete, we will provide corrected versions
- No refund; only replacement or supplementary materials
2.5 Podcast Sponsorships & Advertising
Refund Eligibility:
- Pre-recorded episodes: Typically non-refundable once recorded
- Live episode sponsorships: Refund available if episode is canceled due to our actions
Cancellation by Sponsor:
- More than 30 days: 50% refund
- Less than 30 days: No refund; sponsorship fulfilled as scheduled
3. Non-Refundable Items
The following items are explicitly non-refundable:
- Completed speaking engagements or training sessions
- Customized materials or deliverables once created for you specifically
- Services already rendered
- Deposits applied to engagement or rescheduling
- Administrative or processing fees
- Rush delivery or expedited processing fees
- Travel-related costs incurred on your behalf (flights, hotels, ground transportation)
4. Refund Request Process
4.1 Submitting a Refund Request
To request a refund, contact us within 30 days of the transaction or cancellation:

- Engagement date or service date
- Contract or invoice number
- Reason for refund request
- Original payment method
- Any supporting documentation
4.2 Refund Review & Processing
We will:
- Acknowledge receipt of your refund request within 3 business days
- Review your request against this policy and your engagement agreement
- Provide a decision within 10 business days
- If approved, process the refund within 5-7 business days
Refund Processing Time:
- Credit card refunds: 3-7 business days (depends on issuing bank)
- Bank transfer refunds: 5-10 business days
- Check refunds: 7-14 business days (mailed)
4.3 Refund Disputes
If you dispute our refund decision, you may:
- Request escalation to management within 10 days
- Provide additional documentation supporting your claim
- Pursue informal dispute resolution (see Terms of Service)
- Proceed to arbitration if needed (per Terms of Service)
5. Partial Refunds & Credits
5.1 Prorated Services
If you cancel a service mid-engagement or mid-month:
- We calculate the unused portion based on actual services rendered
- Refund = (Unused Days / Total Days) × Monthly Fee
- Setup fees and initial deposits typically do not prorate
5.2 Credits vs. Refunds
We may offer service credits instead of refunds:
- Credits can be applied to future services
- Credits do not expire unless specified
- Credits are non-transferable
- Credits do not convert to cash
6. Force Majeure
Neither party is liable for non-performance due to force majeure events (natural disasters, war, pandemics, government action). In such cases:
If Brett Johnson Services, LLC} Cannot Perform:
- We will reschedule your service to the earliest mutually available date
- If rescheduling is impossible, we will offer a full refund
- We retain the right to reschedule rather than refund
If You Cannot Proceed:
- Cancellation terms in Section 2 apply
- Force majeure does not waive your cancellation fees
7. Special Circumstances
7.1 Medical or Personal Emergency
If you experience a genuine medical emergency or death in the family within 14 days of a confirmed engagement:
- Contact us immediately at legal@brettjohnson.xyz
- Provide documentation (medical certificate, death certificate, etc.)
- We may waive cancellation fees and offer rescheduling
7.2 Third-Party Failures
If a third-party service fails (e.g., video conference platform crashes, audio equipment malfunction):
- We will reschedule or supplement the engagement at no additional cost
- Refunds are considered only if the engagement cannot be rescheduled
- We are not liable for third-party service failures beyond our control
7.3 Service Quality Issues
If you believe service quality was significantly below standards:
- Notify us within 30 days with specific details
- We will review and may offer: service replacement, partial refund, or service credit
- Disputes regarding quality are subject to arbitration (see Terms of Service)
8. Payment Method & Refund Details
8.1 Original Payment Method
Refunds are issued to your original payment method:
- Credit card → Credit to your card account (3-7 business days)
- Bank transfer → Bank transfer to account on file (5-10 business days)
- Check → Mailed check (7-14 business days)
8.2 Multiple Payment Methods
If you paid via multiple methods, refunds are issued proportionally to each method.
8.3 Foreign Currency Refunds
If you paid in a currency other than USD:
- Refund is issued in USD at the exchange rate on the refund date
- Exchange rate fluctuations are not our responsibility
- Your bank may charge foreign transaction fees
9. Non-Refundable Scenarios
Refunds will NOT be issued if:
- You fail to appear for a scheduled engagement without notice (no-show)
- You breach your obligations under the engagement agreement
- You violate our Terms of Service
- You request a refund beyond 30 days of the transaction
- The service was performed as agreed, but you changed your mind
- You misrepresented your organization or requirements
- You requested customization that was delivered per specifications
10. Refund Exceptions for Specific Services
10.1 Law Enforcement Training
- Special case: Law enforcement agencies may request refunds within 60 days if training does not meet curriculum standards
- Evidence required: Training evaluation forms, attendance records, and specific deficiency documentation
- Refund amount: 25-100% depending on deficiencies
10.2 Corporate Retainers
- Quarterly reviews: Retainer clients may request partial refund after first 90 days if ROI is demonstrably unmet
- Evaluation criteria: Agreed KPIs and success metrics in the engagement agreement
- Refund: Up to 25% of prepaid amount, non-recurring
11. Engagement Agreement Precedence
In the event of a conflict between this Refund Policy and the terms specified in your signed engagement agreement, the engagement agreement takes precedence.
12. Changes to This Policy
We may update this Refund Policy to reflect changes in our services, pricing, or legal requirements. Changes are effective immediately upon posting. Your continued use of brettjohnson.xyz} constitutes acceptance of updated terms.
For engagements entered into before the effective date of policy changes, the refund policy in effect at the time of engagement applies.
